It is your responsibility to review these Terms before use and periodically while using our Site. If at any time you do not accept these Terms, you should not access our Site.

Your continued use of this Site is taken as acceptance of any changes. You may also accept these Terms by clicking "Agree", "Accept" or "Buy", or by ticking a box to that effect, where that option is offered. This includes, without limitation, our products and formulations, the THRIVEAU name and logo, trade marks, copyright, proprietary information, designs, business names, images, product copy, videos, audio, graphics, other files and software (Content). Your use of and access to our Site and its Content does not grant or transfer any right, title or interest in it to you.

No Commercial Use. You may not modify, publish, transmit, take part in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit our Site, products, Content, intellectual property or Third Party Licensed Intellectual Property, in whole or in part, without our prior written consent. We may immediately remove your access to our Site and Content if you breach these Terms. Removing access does not affect any refund you are entitled to under the Australian Consumer Law.

Limited Licence. Where you download our digital products, including our ebooks The Thriving Skin Reset and The Thriving Skin Kitchen and any guides, checklists, planners, video or audio content (Digital Products), or access our Content, you receive a non-exclusive, non-transferable, limited licence to access and use them for your own personal purposes. You may not assign or transfer Digital Products or Content to any other person without our express written consent.

No AI Training Or Data Mining. You must not use our Site, Content, Digital Products or any part of them to train, fine-tune, validate, benchmark or develop any artificial intelligence or machine learning model. You must not use any automated system to scrape, crawl, harvest, index, mine or extract our Site, Content or Digital Products for that purpose. We reserve all rights in our Site, Content and Digital Products for text and data mining and for developing artificial intelligence and machine learning models, whether or not our Site carries a machine-readable notice to that effect.

Our Site and social media channels may link to sites operated by third parties. Unless we expressly say otherwise, we do not endorse, control or approve, and are not responsible for, the content on those sites. It is up to you to decide whether those sites and their content suit you.

6. Privacy

These Terms include our Privacy Policy, which explains how we collect, use, store and disclose your personal information. It can be accessed [here][link]. By using this Site you agree that we may handle your personal information as set out in our Privacy Policy, and you warrant that the information you give us is accurate.

7. Creating An Account

To place orders and access some features of our Site, you may choose to register an account. If you do, you must give us accurate information, including your name, delivery address, a valid email address and telephone number, and you must be at least 18 years old. You warrant that the information you provide is correct when you provide it, and you will update it if it changes. You are responsible for activity on your account, including orders placed on it, so please keep your password secure.

We may suspend or cancel your account at any time, at our discretion, if you breach these Terms or applicable law, or where your conduct harms our reputation. Suspending or cancelling your account does not affect your access to Digital Products you have already paid for, or any order already placed and paid for.

8. Prices And Payment

All prices are in Australian Dollars (AUD) and include Goods and Services Tax (GST). Prices shown on our Site may change at any time without notice. The amount charged to you will be the price displayed when your order is placed.

We may modify or discontinue any product without notice. We are not liable to you or any third party for any modification, price change, suspension or discontinuance of a product.

We may cancel an order and give you a full refund if a product has been discontinued or is out of stock.

From time to time we may offer promotional or early-bird pricing and discount codes. Only one discount code can be used per order, and we may reject or cancel an order where more than one is applied. Discount codes must be used on the terms on which they were issued, which may include eligibility, expiry dates and minimum or maximum order values. Unless stated otherwise, discount codes cannot be combined with any other offer or promotion.

You can pay by credit or debit card or any other payment method offered at checkout. You agree to pay for your order in full at checkout. Where you use a card, you warrant that you are authorised to use it. If payment is declined, we will not process your order.

We may cancel any order where we suspect fraud or other illegal or unauthorised activity, and will refund any amount paid.

9. Shipping

These Terms include our Shipping Policy, which can be accessed [here][link]. In summary:

  • we currently ship within Australia only;
  • orders are dispatched by our fulfilment partner from Victoria;
  • orders of $130 or more (after any discount is applied) receive free standard shipping, and shipping costs for other orders are shown at checkout before you pay;
  • delivery timeframes on our Site and in our Shipping Policy are estimates, and we are not responsible for delays caused by carriers or events outside our reasonable control; and
  • you are responsible for giving us a complete and accurate delivery address.

If anything in this clause differs from our Shipping Policy, our Shipping Policy applies.

10. Returns And Refunds

These Terms include our Returns and Refund Policy, which can be accessed [here][link]. In summary:

Change of mind. Our products are skincare applied directly to the skin. For hygiene reasons we do not accept returns or give refunds for change of mind, including where a product does not suit you.

Damaged in transit. If your order arrives broken, cracked or damaged, please email info@thriveau.com.au within 7 days of delivery with your order number and photos of the product and packaging. Once we have investigated, we will send you a replacement at no cost to you.

Your consumer rights. Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in our no change-of-mind position limits these rights.

11. Digital Products

Every skincare bundle order includes two ebooks, delivered by email: The Thriving Skin Reset: A 30-Day Holistic Guide to Calm, Comfortable Skin and The Thriving Skin Kitchen: 100 Whole-Food Plant-Based Recipes to Nourish From Within. We may offer other Digital Products from time to time.

Where you purchase or receive a Digital Product, you are granted a non-exclusive, non-transferable, limited licence to access and use it for your own personal use. You may not share, assign or transfer a Digital Product to any other person without our express written consent.

You may print one copy of each ebook for your own personal use. Printed copies must not be shared, sold or distributed.

Once payment is confirmed, we will email you a link to download your Digital Product. After you download it, you are responsible for keeping your downloaded copy.

Except as expressly stated, you have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, sell, enhance or in any way exploit a Digital Product.

You must not upload, input or otherwise make a Digital Product available to an artificial intelligence tool. You must not use an artificial intelligence tool to reproduce, summarise, adapt or create a competing or derivative product from a Digital Product.

12. Refunds For Digital Products

We do not give refunds for Digital Products for change of mind, or where you have downloaded or accessed the Digital Product and it works as described. This does not affect your rights under the Australian Consumer Law, set out in clause 21.

If we send you the wrong Digital Product, or your download link does not work, email info@thriveau.com.au and we will send the correct file or a new link at no extra cost.

13. Electronic Communications And Signatures

You agree to be bound by any affirmation, acceptance or agreement you transmit through this Site, including consent to receive communications from us electronically, such as order confirmations, shipping updates and download links.

When you click or tick "I agree", "I consent" or a similar option, your agreement is legally binding and as effective as a handwritten signature.

Accepting these Terms is not consent to receive marketing. We only send marketing emails or messages where you have separately opted in, and every marketing message includes a working unsubscribe option. See our Privacy Policy for details.

14. Information And Advice

Information on our Site, in our blog posts, product descriptions, Digital Products, social media and other content is general information only. It is not professional, medical or health advice for your individual situation and should not replace it. We are not licensed health professionals and are not liable for any reliance on general information we provide.

We do not determine whether our products are appropriate for you. We may decline to supply, and refund the cost of, a product for any reason, including where we believe it may not be appropriate for you or that you should seek professional advice first.

The sale of products on our Site, or reference to any other product, is not an endorsement or recommendation of that product unless we state otherwise.

15. Our Products

You agree to use our products only for their intended purpose and in line with the directions on the packaging and our Site (Guidelines). Any use outside the Guidelines is at your own risk.

Cosmetic products. Our products are cosmetics. They are not therapeutic goods and are not intended to diagnose, treat, cure or prevent any disease or medical condition.

Natural variation. Our products are made with natural, plant-based ingredients and contain no water. Colour, scent and texture may vary slightly between batches. Our balms and butters may soften in warm conditions and firm up in cool conditions. This is normal and not a fault.

Results and suitability. Skin is individual, so results vary from person to person and we do not guarantee specific results. Please read the full ingredient list before purchasing and patch test before first use. Stop using a product if irritation occurs. If you have a known allergy, a skin condition or any concerns, please speak with your medical practitioner before use.

Storage and handling. Please follow the storage and use directions on the label. Keep the lid closed, store out of direct sunlight and heat, and keep water out of the jar. Use the silicone scoop end of the brush supplied, with dry hands, to take product from the jar.

Not for resale. Products bought from our Site, including any samples, are for personal use only. You must not sell or attempt to resell them. We may cancel orders and refuse future orders where we reasonably believe products are being bought for resale.

16. Feedback, Complaints And Disputes

How to complain. We want you to be happy with your order. If you have an issue, please contact us straight away so we can try to resolve it. Use our contact form at thriveau.com.au/pages/contact or email info@thriveau.com.au, and include:

  1. your name;
  2. your email address;
  3. your order number;
  4. details of your concern or complaint; and
  5. what you would like us to do to resolve it.

Acknowledgement. We will acknowledge your complaint within 3 business days.

Resolution. We aim to resolve complaints within 14 business days. If we cannot, we will let you know why and give you an expected timeframe.

Public reviews and statements. We welcome fair, honest feedback. Nothing in these Terms prevents you from sharing a genuine opinion about your experience, or from exercising any right you have under the law that cannot be excluded. You must not publish statements about us that are unlawful, including statements that are defamatory, misleading or deceptive, threatening or harassing, or that disclose confidential information or another person's personal information without consent. We may respond to such content, or ask a platform to moderate it where it appears unlawful or breaches that platform's terms. If you have a problem, please use the process above first so we can try to resolve it with you.

Mediation. If a dispute cannot be resolved, it will be referred to mediation under the mediation rules of the Resolution Institute. If it is not resolved at mediation, you agree to submit to the exclusive jurisdiction of the courts of New South Wales.

17. Submitting Content To Our Site And Social Media

We love hearing from you. You may be invited to leave a review after purchase, comment on our blog, or interact with us on social media. Where you submit feedback, comments, photos or other content, you:

  1. warrant that you are the sole author and owner of the content, or have all consents and permissions needed to share it;
  2. give us permission to post and otherwise use it on our Site, social media and other channels;
  3. agree that we may use artificial intelligence tools to moderate, translate, summarise, respond to and analyse it;
  4. consent to us using the content, and any edited or adapted version of it, in the ways described in these Terms, even where this would otherwise infringe your moral rights under the Copyright Act 1968 (Cth), being your right to be identified as author, your right not to have authorship falsely attributed, and your right not to have the content treated in a derogatory way;
  5. warrant that the content does not breach these Terms; and
  6. warrant that you are at least 18 years old.

We may remove or decline to publish any content that:

  1. is defamatory or otherwise unlawful, abusive or obscene;
  2. attacks our team or another contributor;
  3. discloses your or anyone else's personal information; or
  4. is unrelated to the post or product it is attached to.

22. Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless us, our related entities, and our and their officers, agents and employees, from any loss, liability, claim or demand (including reasonable legal fees on a full indemnity basis) made by a third party arising from your use of this Site in breach of these Terms, any breach of your representations and warranties in these Terms, or your breach of any law or the rights of a third party.
